The Federal Deposit Insurance Corporation (FDIC) has dropped a重磅打击 on Bank of England, Arkansas, for its involvement in a massive VA loan scam. The FDIC announced a settlement with the bank and nine former employees for violations of key consumer protection laws, including the Federal Trade Commission Act, Real Estate Settlement Procedures Act, Fair Credit Reporting Act, and Home Mortgage Disclosure Act.
Bank of England has agreed to pay a staggering $1.5 million civil money penalty (CMP) for its deceptive practices. The bank’s misdeeds, which resulted in $1.9 million in remediation to over 900 harmed consumers, included misleading veterans into refinancing their VA loans with the promise of skipped payments and better loan products. However, these promises were a mirage, leaving many veterans and their families financially vulnerable.
FDIC Division of Depositor and Consumer Protection Director Mark Pearce emphasized the agency’s dedication to consumer fairness: “Today’s announcement demonstrates FDIC’s commitment to ensuring consumers are treated fairly, and that those responsible, including the bank and individuals employed by the bank, are held accountable for their illegal actions.”
Section 5 of the Federal Trade Commission Act was violated when the bank misrepresented its relationship with the VA and promised payment-skipping benefits on refinanced mortgages. The bank also breached the Real Estate Settlement Procedures Act (RESPA) by engaging in co-marketing arrangements, desk rental agreements, and online lead generation deals that resulted in fees paid for mortgage loan referrals.
In addition to the bank’s penalties, nine former employees face individual enforcement actions for their role in deceptive practices. These include Ryan Qarana, Assistant Branch Manager, who stipulated to a Prohibition Order and an Order to Pay CMP.
