MUSKOGEE, OKLAHOMA – The United States Attorney’s Office for the Eastern District of Oklahoma announced a stunning guilty plea in an illegal immigration case. Augustin Borja-Gaona, also known by several aliases, faces a severe punishment after admitting to unlawful reentry into the country.
Borja-Gaona, 56, has a history of removal from the United States in 1999, 2002, 2007, and 2012. He was caught in the U.S. on March 19, 2025, without proper authorization to return, according to charges brought against him.
This is no ordinary immigration violation; it’s a serious federal crime with a potential sentence of up to ten years in prison and a fine reaching $250,000. The investigation leading to Borja-Gaona’s arrest was conducted by the U.S. Department of Homeland Security’s Immigration and Customs Enforcement Division and the Pittsburg County Sheriff’s Office.
Part of the nationwide Operation Take Back America, this case showcases the Department of Justice’s efforts to combat illegal immigration and protect communities from transnational criminal organizations. Assistant U.S. Attorney Dak T. Cohen is handling the prosecution for the United States.
Judge Gerald L. Jackson has accepted Borja-Gaona’s plea and ordered a presentence investigation report. The final sentence will be determined by a U.S. District Court Judge, considering the U.S. Sentencing Guidelines and other relevant factors.
Borja-Gaona remains in custody of the United States Marshals Service until his sentencing is decided.
