Austin’s streets are no stranger to violence, and today they saw yet another grim chapter unfold. Three-time felon Frank Horton Lee Jr., 38, made his initial appearance in federal court after being arrested for possession of a firearm.
Lee was taken into custody by Austin Police Department officers following a traffic stop on May 24. According to court documents, authorities found a .45 ACP caliber semiautomatic pistol on him.
The complaint filed against Lee states that he is a convicted felon and faces one count of possession of a firearm by a felon. The gravity of the charge is not lost on anyone; if convicted, Lee could spend up to 15 years behind bars.
U.S. Attorney Justin Simmons for the Western District of Texas was quick to announce the charges, underscoring the severity of the offense. The case is currently being investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Austin Police Department.
Assistant U.S. Attorney Alan Buie will be handling the prosecution of Lee. It’s important to note that a criminal complaint is merely an allegation, and all defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
