Grimy Times has learned that Houston-based Autobuses Ejecutivos, LLC, operating as Omnibus Express, has pleaded guilty to hiring discrimination in a case that spanned over a decade. According to court documents, the bus company preferred hiring temporary H-2B workers over US citizens for operator positions.
Under the agreement, Omnibus Express will establish a $208,000 fund to compensate individuals who were victims of their discriminatory practices, pay $37,800 to the US government in civil fines, and be subject to two years of monitoring of their hiring and recruitment practices by the government.
Individuals who applied for an operator position with Omnibus Express between August 2012 and February 2013 and were not hired are advised to contact Joann Sazama at (202) 307-3092 or Ryan Thompson at (202) 616-5557.
"Federal law prohibits employers from discriminating during hiring and recruitment based on citizenship status," said Molly Moran, Acting Associate Attorney General for the Civil Division. "The government is committed to investigating and combating discriminatory hiring practices that prevent US citizens and workers with authorization to compete equally for employment."
The Special Counsel for Unfair Employment Practices Related to Immigration is responsible for enforcing the antidiscrimination provision of the Immigration and Nationality Act. The law prohibits discrimination based on citizenship status or national origin during hiring, firing, recruitment, or referral, unfair documentation practices, retaliation, or intimidation.
"The law is clear," Moran added. "Employers must provide equal opportunities to all applicants, regardless of their immigration status."
