Parkchester Preservation Management, LLC, Tenant Blacklisting, New York 2023

New York – New York Attorney General Letitia James has announced a landmark settlement with Bronx landlord Parkchester Preservation Management, LLC (Parkchester Management) for their illegal practice of tenant blacklisting. The company, under scrutiny for denying rental applications based on housing court records and sending denial letters indicating such reviews, has been halted by the AG’s office.

Attorney General James emphasized that every New Yorker deserves a fair chance at housing, stating that using housing court records to deny applicants is discriminatory and against the law. The AG’s office will continue to combat such unfair practices.

In 2019, New York’s Real Property Law was amended to make tenant blacklisting illegal, specifically outlawing denial of housing based on past landlord-tenant court cases. Parkchester Management was found by the Office of the Attorney General (OAG) to have violated this law by improperly obtaining and using housing court records.

Under the settlement, Parkchester Management is ordered to cease its discriminatory tenant screening policies, allow previously denied tenants to re-apply, and to publicly affirm compliance with state anti-discrimination laws. The company must also remove certain questions from its applications and undergo training on fair housing regulations. Failure to comply may result in further legal action.

Bronx Borough President Vanessa L. Gibson commended Attorney General James for her swift action against Parkchester Management, highlighting the importance of accountability during the city’s ongoing housing crisis.

The OAG recommends landlords refrain from requesting applicants’ prior housing court records to ensure compliance with state laws and protect tenants from unfair discrimination.
