Marston delivered the verdict today, alongside three years of supervised release, after Fernandes-Calixto was convicted of forcibly assaulting, resisting, opposing, impeding, intimidating, and interfering with an officer of Immigration and Customs Enforcement (ICE).

The incident unfolded on April 2, 2025, when ICE Enforcement and Removal Operations (ERO) officers arrested Fernandes-Calixto on immigration charges. Instead of complying, the defendant attempted a desperate escape while still handcuffed. Court filings detail a violent struggle where Fernandes-Calixto not only pushed the officer but also repeatedly attempted to strike him. He briefly succeeded, escaping custody before vanishing into the Northeast Philadelphia area.

The escape triggered a significant manhunt, culminating in Fernandes-Calixto’s apprehension later that evening. But it wasn’t a simple collar. The Philadelphia Police Department SWAT team was required to assist in taking him into custody, highlighting the danger posed by his initial resistance and flight. The full force of the law was needed to bring him down.

United States Attorney David Metcalf made the announcement, framing the sentencing as part of a larger, nationwide crackdown. The case falls under “Operation Take Back America,” a Department of Justice initiative intended to combat illegal immigration and dismantle transnational criminal organizations. The DOJ claims this operation “marshals the full resources” to eliminate cartels and protect communities. Critics call it political posturing.

The investigation was spearheaded by ICE ERO, indicating a clear focus on individuals facing immigration-related charges who resort to violence. The sentencing sends a message, however hollow, that attacks on federal officers won’t be tolerated. The defendant, also known as Emanuel Fernandes and Emanuel Bartholomew, will now begin serving his sentence, another face in the overcrowded federal prison system.
