BOSTON – The grimy streets of Weymouth have been witness to a federal crime that echoes the dark corners of immigration law. Brazilian national Josimar Fernandes-Pessoa, 38, has been indicted for the heinous act of illegal reentry into the United States after his deportation.
According to the gritty indictment, Fernandes-Pessoa was forcibly removed from these shores in 2019, following his capture near the U.S.-Mexico border in Texas. The defendant had previously pleaded guilty to improper entry by an alien charges in the Western District of Texas before being sent packing.
But it seems that after his forced exit, Fernandes-Pessoa managed to slip back into the land of the free. Now, he faces one count of unlawful reentry of a deported alien—a crime with teeth that could land him up to two years behind bars, a year of supervised release, and a fine that’s more than $250,000.
For Fernandes-Pessoa, this is no mere slap on the wrist. Sentences are handed down by federal district court judges based on U.S. Sentencing Guidelines and statutes that govern criminal cases in the United States. The defendant also faces the possibility of being deported once again upon completing any sentence imposed.
The U.S. Attorney Leah B. Foley and Patricia H. Hyde, Field Office Director of U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations in Boston, have had no qualms about announcing this grim news. Assistant U.S. Attorney David Cutshall is the man at the helm of this criminal prosecution.
As for the details contained within the charging documents, they are nothing but allegations against the defendant. Fernandes-Pessoa is presumed innocent until proven guilty beyond a shadow of a doubt in a court of law. This city has seen many a tale of deceit and law-breaking, but none as stark as this.
