A disturbing case of child abuse has come to light in McLaughlin, South Dakota, where a 40-year-old man was sentenced for Abusive Sexual Contact by Force.
Brian Ducheneaux, 40, was convicted of Abusive Sexual Contact by Force, a federal offense. The incident occurred in October 2014, when Ducheneaux, who was staying with family in Wakpala, South Dakota, entered a bedroom belonging to young girls.
According to the investigation by the Bureau of Indian Affairs, Standing Rock Agency, Ducheneaux laid on the bed next to the victim and placed his hands between her legs, making direct skin to skin contact with her genitalia.
Ducheneaux was indicted by a federal grand jury on February 11, 2015, and pled guilty on June 22, 2015.
On September 21, 2015, U.S. District Judge Charles B. Kornmann sentenced Ducheneaux to 110 months in custody, followed by 5 years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
The conviction is a result of the tireless efforts of the Bureau of Indian Affairs, Standing Rock Agency, and Assistant U.S. Attorney Troy R. Morley, who prosecuted the case.
The defendant was immediately turned over to the custody of the U.S. Marshals Service after the sentencing.
