Buffalo Man Sentenced for Marijuana Possession

A 33-year-old Buffalo man was sentenced to 18 months in prison for possession with intent to distribute marijuana. Demerius Rivera, 33, of Buffalo, was convicted of the crime after officers with the Buffalo Police Narcotics Unit and the Lancaster Police Department SWAT Team executed a search warrant at 77 Landon Street in Buffalo on June 6, 2012.

During the search, officers found 25 ounces of marijuana packaged for sale in a dresser in the rear bedroom of the residence. Rivera was encountered in the room and admitted to owning the marijuana. Upon further questioning, he revealed there were two guns "under the bed" in the bedroom. Officers recovered two shotguns under the bed and a third shotgun in the basement.

Assistant U.S. Attorney Frank T. Pimentel handled the case, stating that Rivera’s actions were a threat to public safety. Rivera’s sentence marks the culmination of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Buffalo Police Department, and the Lancaster Police Department.

The investigation, led by Acting Special Agent in Charge James S. Higgins, New York Field Division, the Buffalo Police Commissioner Daniel Derenda, and Lancaster Police Chief Gerald Gill, uncovered Rivera’s involvement in the sale of marijuana. Rivera’s prison sentence serves as a reminder of the severe consequences for those involved in illicit drug activity.
