Failure to Pay Child Support Lands California Woman in Hot Water

Cheryl K. Ernesti, a 42-year-old Anaheim, California resident, has been slapped with a federal indictment for failing to pay over $19,853 in past due child support. The indictment, handed down by a federal grand jury on April 2, 2013, is a serious charge that could land Ernesti behind bars for up to two years and/or a $250,000 fine.

According to court documents, Ernesti appeared before U.S. Magistrate Judge John E. Simko on November 6, 2013, and pled not guilty to the indictment. The investigation into Ernesti’s alleged failure to pay child support was conducted by the Department of Health and Human Services, Office of Inspector General. Assistant U.S. Attorney Thomas J. Wright is leading the prosecution.

The maximum penalty for a conviction is two years’ imprisonment and/or a $250,000 fine, one year supervised release, one additional year upon revocation, a $100.00 assessment fee to the Federal Crime Victims Fund, and child support restitution amount owing at the time of sentencing.

Ernesti was released on bond pending trial, which has yet to be scheduled. It’s essential to note that the charge is merely an accusation, and Ernesti is presumed innocent until and unless proven guilty.
