Darian Libert, Gun Possession, South Dakota 2024

Rapid City, SD – In a case that highlights the dangers of gun violence, 26-year-old Darian Libert has been sentenced to 1 year and 9 months in federal prison for his role in a firearm possession case.

On July 26, 2024, U.S. District Judge Karen E. Schreier handed down the sentence, which also included three years of supervised release and a $100 special assessment to the Federal Crime Victims Fund.

The investigation began when Libert was involved in an accident while driving a four-wheeler on Deadwood Avenue in Rapid City on July 2023. He fled the scene but was later located by law enforcement officers and found to be in possession of a Sturm, Ruger & Company .380 AUTO caliber semi-automatic pistol.

Libert, a previously convicted felon, is prohibited from possessing firearms. His guilty plea was entered on May 1, 2024, after he was indicted by a federal grand jury in February of the same year.

This case is part of Project Safe Neighborhoods (PSN), a program aimed at reducing violent crime and gun violence in communities across the nation. The initiative brings together law enforcement agencies and community organizations to foster trust, support prevention efforts, and set strategic enforcement priorities.

The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms, and Explosives and the Rapid City Police Department, with Assistant U.S. Attorney Benjamin Patterson prosecuting the case. Libert was immediately remanded to the custody of the U.S. Marshals Service following the sentencing.
