Schenectady Man Faces Up to 10 Years for Unlawful Handgun Possession
ALBANY, NEW YORK – In a shocking turn of events, Darryl Flannagan, 26, of Schenectady, New York, has pleaded guilty to unlawfully possessing a firearm and ammunition while subject to an order of protection.
The announcement was made by U.S. Attorney Richard S. Hartunian and Andrew W. Vale, Special Agent in Charge of the Albany Division of the Federal Bureau of Investigation (FBI).
According to the charges, Flannagan admitted to possessing a loaded 9 millimeter handgun on May 19, 2016, which he was attempting to deliver to a friend. At the time, he was acting nervously and wearing a heavy leather coat on a warm day. When stopped by a Schenectady Police Officer, Flannagan attempted to flee but was quickly apprehended.
The loaded handgun and six rounds of ammunition were found in the coat. The court order of protection, issued by Colonie Town Court, prohibited Flannagan from having almost any contact with his child’s mother. Under federal law, being subject to such an order prohibits individuals from possessing firearms or ammunition.
Flannagan faces a maximum sentence of 10 years in prison, a fine of up to $250,000, and a term of post-imprisonment supervised release of up to 3 years. He is scheduled to be sentenced on January 4, 2017, by Senior U.S. District Judge Gary L. Sharpe.
This case was a collaborative effort between the FBI, the Schenectady Police Department, and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), with Assistant U.S. Attorney Michael Barnett leading the prosecution.
As the investigation unfolds, it becomes clear that Flannagan’s actions were reckless and put himself and others at risk. His plea comes as a relief to those affected by his actions, and it serves as a reminder of the importance of adhering to court orders and respecting the law.
With this guilty plea, Flannagan faces a serious consequence for his actions. The outcome will be determined by Judge Sharpe, taking into account the U.S. Sentencing Guidelines and other factors.
