A 43-year-old Silver Spring man has been charged with producing and possessing child sexual abuse material. David Alain Schmidt, 43, of Silver Spring, Maryland, was indicted by a federal grand jury for his alleged crimes.

According to the indictment, in October 2024, Schmidt enticed a minor to produce child sexual abuse material and he also possessed sexually explicit images of a minor victim. If convicted, Schmidt faces a mandatory minimum sentence of 15 years in federal prison for producing child sexual abuse material and a maximum of 10 years in federal prison for possessing child sexual abuse material.

The case against Schmidt was brought as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the U.S. Attorney’s Offices and the Criminal Division’s Child Exploitation and Obscenity Section. The initiative aims to combat the growing epidemic of child sexual exploitation and abuse.

The investigation into Schmidt’s alleged crimes was led by Homeland Security Investigations (HSI) Baltimore and the Montgomery County Police Department. Acting U.S. Attorney Phil Selden commended the agencies for their work in the investigation.

Schmidt’s case is being prosecuted by Assistant U.S. Attorney Megan S. McKoy. An indictment is not a finding of guilt, and Schmidt is presumed innocent until proven guilty at a later criminal proceeding.

Individuals charged by indictment are typically subject to a later trial, where the prosecution will present evidence to prove their guilt beyond a reasonable doubt. If convicted, Schmidt could face significant prison time and other penalties.

As part of the investigation, HSI and the Montgomery County Police Department worked to identify and rescue any potential victims of Schmidt’s alleged crimes. The case serves as a reminder of the importance of protecting children from sexual exploitation and abuse.
