David Marrowbone, Failure to Register as Sex Offender, South Dakota 2014

David Marrowbone, a 51-year-old Eagle Butte man, has been accused of failing to register as a sex offender, according to federal authorities.

US Attorney Brendan V. Johnson announced that Marrowbone was indicted by a federal grand jury on June 10, 2014, for the crime. He appeared before US Magistrate Judge Mark A. Moreno on June 26, 2014, and pleaded not guilty to the Indictment.

According to the Indictment, Marrowbone moved and failed to change and update his sex offender registration as required by law between February 3, 2014, and March 13, 2014. The maximum penalty upon conviction is 10 years in custody and/or a $250,000 fine, a minimum of 5 years up to life of supervised release, and a $100 special assessment to the Federal Crime Victims Fund.

Marrowbone was previously convicted of a sex offense that required him to register as an offender. In fact, he signed paperwork acknowledging his duty to register as a sex offender.

The charge is merely an accusation, and Marrowbone is presumed innocent until and unless proven guilty. The investigation is being conducted by the U.S. Marshals Service, and Assistant U.S. Attorney Mikal Hanson is prosecuting the case.

Marrowbone was remanded to the custody of the U.S. Marshals Service, and trial has been set for August 26, 2014. The U.S. Marshals Service is working diligently to ensure that Marrowbone is brought to justice for his alleged crimes.
