David Oday Smith, 39, is headed back inside for two years. Cops spotted him lugging a bag near a D.C. bus stop on July 14, 2025. When they moved in, Smith ran, tossing the bag over a fence. Inside? A loaded .40 caliber Glock 27 with 15 rounds. Witnesses saw the whole thing. He was quickly found hiding on a porch.

This wasn’t a first offense. Not even close. Smith already did a 30-year stretch in a Maryland prison, convicted in 2009 of second-degree murder, first-degree assault, and using a handgun in the commission of a crime. Released after roughly 15 years, he was legally barred from owning a firearm. This violation turned a simple gun rap into a federal case.

The bust was a joint operation between the ATF Washington Field Office and the Metropolitan Police Department’s Crime Suppression Team. Assistant U.S. Attorney David B. Liss prosecuted the case, plugging it into the “Make D.C. Safe and Beautiful” initiative – a hardline, Trump-era push for tougher gun penalties.

Smith’s history meant a conviction was almost a given. A 30-year murder sentence doesn’t just disappear. This time, the judge handed down a two-year term. Another chapter in a life already defined by violence and run-ins with the law.
