Dentex Dental Mobile, Inc. Settles Discrimination Allegations
PHILADELPHIA – In a shocking case of medical malpractice, Dentex Dental Mobile, Inc. (“DDMI”), a Pennsylvania corporation located in Huntington Valley, has reached a settlement with the United States to resolve allegations that it refused to treat an HIV-positive patient in violation of the Americans with Disabilities Act (“ADA”).
According to the United States investigation, DDMI’s mobile clinic in Chester, PA, refused to treat a patient who had disclosed his HIV status in paperwork. The Office Manager allegedly referred the patient to an AIDS clinic for further assistance, which is a clear violation of the Americans with Disabilities Act.
The Americans with Disabilities Act states that a healthcare provider cannot refer a patient with HIV or AIDS to another provider simply because the patient has HIV or AIDS. This case serves as a stark reminder of the importance of equal treatment for all patients, regardless of their medical condition.
As part of the settlement, DDMI has agreed to implement a non-discrimination policy, conspicuously post that policy, and adequately train employees and contractors regarding the policy. The Agreement is in effect for two years.
This case was handled by Assistant United States Attorney Jacqueline C. Romero, who worked tirelessly to ensure that DDMI takes responsibility for its actions and provides a safe and non-discriminatory environment for all patients.
The settlement is a significant victory for patients with HIV and AIDS, who deserve equal treatment and care from healthcare providers. We hope that this case serves as a warning to all healthcare providers to adhere to the Americans with Disabilities Act and treat all patients with dignity and respect.
Dentex Dental Mobile, Inc., a Pennsylvania corporation, was charged with violating the Americans with Disabilities Act by refusing to treat an HIV-positive patient. The case was settled out of court, with DDMI agreeing to implement a non-discrimination policy and train employees.
