Donald Melvin, Armed Career Criminal, North Carolina 2023

A Raleigh man with a history of crime has been sentenced to 188 months in prison for possession of a firearm by a felon.

Donald Melvin, 52, was living at an apartment in Raleigh on January 6, 2022, when Raleigh Police officers attempted to serve an outstanding arrest warrant. Initially, Melvin lied about his identity, but officers were able to confirm his identity and took him into custody after he attempted to flee.

According to court documents, Melvin was carrying a loaded 9mm gun when he was arrested. A search of his apartment revealed four additional firearms, ammunition, and a variety of narcotics, including heroin, cocaine, fentanyl, and Phencyclidine.

The firearms recovered at the apartment included a 9mm with an extended magazine, two 12-gauge shotguns, and a .243 caliber rifle. As an armed career criminal, Melvin’s previous convictions for drug trafficking and breaking and entering qualified him for the sentencing.

On March 9, 2023, Melvin pleaded guilty to the charge. U.S. District Judge Louise W. Flanagan presided over the sentencing hearing. U.S. Attorney Michael Easley made the announcement after the sentencing.

The Bureau of Alcohol, Tobacco, Firearms and Explosives and Raleigh Police Department investigated the case, with Assistant U.S. Attorney Ashley Foxx prosecuting the case.

According to court documents, Melvin will serve 188 months in prison followed by five years of supervised release. His previous convictions for drug trafficking and breaking and entering qualified him as an armed career criminal. The sentencing was announced by U.S. Attorney Michael Easley.
