Defendant Sentenced to 10+ Years for Montana Crime
A Basin, Wyoming man, Duane Allen Swank, Jr., 36, has been sentenced to 125 months in prison for a heinous crime committed on the Crow Indian Reservation.
The crime, which occurred on July 4, 2021, involved the sexual assault of a woman named Jane Doe, while she was a passenger in a stolen car driven by Swank. After dropping off two other individuals in Billings, Swank allegedly sexually assaulted Jane Doe, and the two then drove toward the Crow Indian Reservation on back roads. During the drive, Swank stopped the car and raped Jane Doe, who managed to escape after Swank fell asleep.
Following the rape, DNA extracted from Jane Doe was matched to Swank’s DNA profile, leading to his arrest and subsequent prosecution. The U.S. Attorney’s Office, in conjunction with the FBI and the Bureau of Indian Affairs, conducted the investigation.
U.S. District Judge Susan P. Watters presided over the case, which resulted in Swank’s guilty plea in March 2025. As part of his sentence, Swank will also serve 10 years of supervised release and pay $2,988 in restitution.
The U.S. Attorney’s Office praised the collaborative efforts of law enforcement agencies in bringing this case to a successful conclusion.
The case highlights the importance of holding perpetrators accountable for their crimes, particularly those committed on Native American reservations. The Crow Indian Reservation, like many other reservations, faces unique challenges in addressing crimes committed on their lands.
As this case demonstrates, justice can be served, but it requires the dedication and hard work of law enforcement agencies and the courts.
