East Cleveland Man Indicted for Firearms Violation in Marijuana Trafficking Case
A federal grand jury has indicted Keli Dunnican, 42, of East Cleveland, Ohio, on charges of using a firearm while trafficking marijuana, U.S. Attorney Justin E. Herdman announced.
Dunnican was indicted on one count each of possession with intent to distribute marijuana, use of a firearm in relation to drug trafficking, and being a felon in possession of a firearm. According to the indictment, Dunnican possessed a Ruger, Model P95 9mm handgun and marijuana intended for distribution on November 8, 2017.
Dunnican is prohibited from possessing a firearm due to prior felony convictions for involuntary manslaughter and felonious assault, the indictment states. The case was investigated by the Ohio Adult Parole Authority, the East Cleveland Police Department, and the Bureau of Alcohol, Tobacco, Firearms, and Explosives.
Assistant U.S. Attorney James P. Lewis is prosecuting the case. If convicted, Dunnican’s sentence will be determined by the court after review of factors unique to this case, including his prior criminal record, role in the offense, and characteristics of the violation.
The maximum sentence for each charge is as follows: possession with intent to distribute marijuana, up to 5 years in prison; use of a firearm in relation to drug trafficking, up to 10 years in prison; and being a felon in possession of a firearm, up to 10 years in prison. In all cases, the sentence will not exceed the statutory maximum and in most cases will be less than the maximum.
An indictment is only a charge and is not evidence of guilt. A defendant is entitled to a fair trial, in which it will be the government’s burden to prove guilt beyond a reasonable doubt.
