David Ralph Webber, a Henderson, Nevada man, pleaded guilty to smuggling misbranded erectile dysfunction drugs from India into the United States. Webber, who owned and operated Passion Plus Enterprises Inc. and Whole Science Health, imported hundreds of thousands of prescription drug capsules and tablets containing sildenafil and tadalafil, the active ingredients in Viagra and Cialis. He sold these misbranded drugs to stores in Nevada and elsewhere, making over $1.9 million in revenue.
Webber’s scheme involved falsely declaring wire transfers to Indian manufacturers as ‘business management consultancy services’ to evade customs detection. He also paid a packaging company to falsely label the capsules with names like ‘Ride’ and ‘Kinky Kong’, and to list false ingredients, claiming the drugs were ‘100% Natural’ and didn’t require a prescription.
Webber’s guilty plea includes one count of introduction of a misbranded drug into interstate commerce and one count of mail fraud. He faces sentencing on October 19, 2026, before United States District Judge Jennifer A. Dorsey.
The case highlights the dangers of unregulated prescription drugs and the importance of FDA oversight. Webber’s actions put countless consumers at risk, and his guilty plea serves as a warning to others who would engage in similar schemes.
