TAMPA, FL – Erik Barner, 44, of St. Petersburg, is facing a potentially lengthy federal prison sentence after admitting to running drugs and illegally possessing firearms. Barner pleaded guilty this week to four counts of possessing a controlled substance with intent to distribute and one count of being a convicted felon in possession of a firearm. The charges stem from a series of sales to a confidential informant and a subsequent raid on his property.
According to court documents, Barner peddled cocaine to an undercover operative with the St. Petersburg Police Department on February 22nd, March 1st, and again on March 10th of this year. The drug deals triggered a search warrant for both Barner’s residence and his vehicle. Authorities weren’t disappointed. The search uncovered a small arsenal – four firearms and assorted ammunition scattered throughout the house.
The haul didn’t stop there. Investigators also found 176 grams of cocaine stashed inside Barner’s vehicle. This wasn’t Barner’s first rodeo with the law, or with cocaine. Court records reveal a lengthy criminal history, including prior felony convictions for possession of cocaine, throwing a deadly missile at an occupied vehicle, and two separate convictions for trafficking cocaine. Federal law explicitly prohibits Barner from owning or possessing any firearms or ammunition due to his extensive criminal record.
Each of the four drug offenses carries a maximum sentence of 20 years in federal prison. But the real risk comes from the firearm charge. Barner faces a minimum mandatory sentence of 15 years, and potentially life, behind bars. A sentencing date has not yet been scheduled, leaving Barner to contemplate his choices while awaiting word from the court.
The investigation was a joint effort between the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the St. Petersburg Police Department. Assistant United States Attorney Samantha Newman is prosecuting the case. This case is being touted as part of the Department of Justice’s “Project Safe Neighborhoods” initiative, a program aimed at reducing violent crime and gun violence.
Project Safe Neighborhoods, a familiar refrain in federal law enforcement, focuses on building trust with communities, supporting local violence prevention groups, and prioritizing strategic enforcement. Whether it will actually make a dent in the cycle of crime remains to be seen, but for Erik Barner, the program has already delivered a guilty plea and the looming prospect of decades in prison.
