Michael Delahanty, Violent Minor Assault, New Jersey 2024

Three former and current Ewing Township Police Department officers have been hit with heavy charges for a chilling incident involving the violent treatment of a minor during an arrest. Retired Lieutenant Michael Delahanty, 51, of Robbinsville, New Jersey, and two active officers, Matthew Przemieniecki, 43, from Hamilton, and Justin Ubry, 33, of Burlington, have been indicted on civil rights violations by Acting U.S. Attorney Rachael A. Honig.

The horror unfolded on January 5, 2018, when over a dozen Ewing Township officers responded to a stolen vehicle report. The accused officers are alleged to have subjected the minor victim to shocking brutality after locating him at a shed. Delahanty is charged with felony deprivation of rights under color of law causing bodily injury, while Przemieniecki and Ubry face misdemeanor charges.

According to the indictment, Delahanty stepped on the back of the victim’s head with his boot, driving his face into the snow. Przemieniecki and Ubry followed suit by kicking snow directly into the minor’s face. The officers’ actions were deemed unreasonable and excessive, violating the victim’s constitutional rights. Delahanty and Przemieniecki could face up to 10 years in prison and a $250,000 fine, while Ubry faces one year in prison and a $100,000 fine.

U.S. Attorney Honig praised the FBI Trenton Resident Agency for leading the investigation. The charges are part of a broader Civil Rights Criminal Enforcement Initiative, a partnership between federal and state agencies to combat civil rights violations by law enforcement officers.

Defendants Delahanty, Przemieniecki, and Ubry surrendered this morning and will appear via videoconference before U.S. Magistrate Judge Tonianne J. Bongiovanni. The charges and allegations in the indictment are merely accusations, with the defendants maintaining their innocence until proven guilty.
