BIRMINGHAM, Ala. – Robert D. Smith, 39, a former Federal Bureau of Prisons (FBOP) Corrections Officer, will spend the next 24 months behind bars after being sentenced today in federal court for the sexual abuse of inmates while stationed at the Federal Correctional Institution in Aliceville, Alabama (FCI-Aliceville). Smith, who pleaded guilty on January 11, will also face 15 years of supervised release following his imprisonment. The case lays bare a disturbing pattern of abuse of power within the federal prison system.
The Justice Department is framing the sentence as a significant step in its ongoing effort to “root out sexual misconduct” within the FBOP. Deputy Attorney General Lisa Monaco stated Smith’s “egregious acts have no place” within the Bureau, and that he has been “held to account for abusing of his position of trust.” But for the victims, justice is a long road, and this sentence represents only a single case in what officials admit is a widespread problem.
Assistant Attorney General Kristen Clarke of the Justice Department’s Civil Rights Division minced no words, stating Smith “sexually abused and assaulted vulnerable women inmates and thought he would get away with his crimes.” Clarke emphasized the Department’s “zero tolerance” policy for sexual assaults within correctional facilities and urged survivors to come forward. The investigation revealed Smith deliberately targeted inmates, exploiting vulnerabilities and utilizing areas of the prison devoid of surveillance to commit his offenses.
Court documents detail two separate incidents. In or around February 2019, Smith engaged in a sexual act with a female inmate in his office within the facilities department, specifically choosing a location “away from cameras and other inmates and officers.” A second incident occurred between July 6, 2018, and November 15, 2018, where Smith abused another inmate in the mechanical room, accessed with a key and similarly shielded from observation. The calculated nature of these acts underscores the deliberate abuse of authority.
U.S. Attorney Prim F. Escalona for the Northern District of Alabama affirmed that corrections officers are tasked with ensuring the “safety and security” of those incarcerated, and vowed continued collaboration with law enforcement to prosecute those who violate public trust. Justice Department Inspector General Michael E. Horowitz highlighted the crucial role of surveillance cameras in preventing such misconduct, noting that Smith specifically targeted areas lacking coverage. The OIG has repeatedly flagged inadequate camera use within FBOP facilities.
The case was investigated by the DOJ-OIG, and prosecuted by Assistant U.S. Attorney Michael Royster and Trial Attorney Anna Gotfryd of the Civil Rights Division’s Criminal Section. While the FBOP claims commitment to addressing misconduct, critics argue that systemic issues within the Bureau demand more comprehensive reform to protect vulnerable inmates from predatory officers like Robert D. Smith. The question remains: how many more victims are out there, and how can the system be fixed to prevent future abuses?
