Tuskahoma Man Sold Ammo to Felon, Faces Federal Charges
A 53-year-old Tuskahoma resident has admitted to selling ammunition to a prohibited person, a crime that carries significant federal penalties.
Russell Richard Fincher, 53, of Tuskahoma, Oklahoma, pleaded guilty to selling 60 rounds of .40 caliber ammunition to an individual he had reason to believe was a felon.
The charges against Fincher arose from an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives. As part of the plea agreement, Fincher admitted that on May 5, 2023, he knowingly sold the ammunition to a prohibited person. He also confessed to engaging in the business of dealing in firearms without a license between February 2021 and June 2023.
Under federal law, individuals engaged in the business of dealing in firearms are required to obtain Federal Firearms Licenses and run background checks on potential buyers. Fincher’s actions put both himself and others at risk by ignoring these crucial safety protocols.
Assistant United States Attorney Joshua Satter represented the United States in the case. The Honorable D. Edward Snow, U.S. Magistrate Judge in the Eastern District of Oklahoma, accepted the plea and ordered the completion of a presentence investigation report.
The guilty plea is a stark reminder of the importance of adhering to federal firearms laws and regulations. Fincher’s actions demonstrate a reckless disregard for the safety of others, and his punishment will reflect the severity of his crimes.
As the investigation continues, it is essential to remember that the sale of ammunition to prohibited persons is a serious offense with significant consequences. This case serves as a warning to those who would ignore the law and put others at risk.
The Department of Justice remains committed to protecting the public and upholding the law. We will continue to work tirelessly to bring those responsible for these crimes to justice.
