Felon in Possession of a Firearm Lands Fort Thompson Man in Hot Water

Samuel Redwater, a 22-year-old Fort Thompson man, has pleaded guilty to being a felon in possession of a firearm. The charge stems from an incident on December 19, 2012, in which Redwater knowingly possessed a firearm, despite having been previously convicted of a crime punishable by imprisonment for a term exceeding one year.

According to court documents, Redwater’s prior conviction disqualified him from owning a firearm. However, he knowingly possessed one, which had been previously shipped and transported in interstate and foreign commerce.

Redwater appeared before U.S. District Judge Roberto A. Lange on April 2, 2013, and pleaded guilty to Count I of the Indictment. Assistant U.S. Attorney Kathryn N. Rich is prosecuting the case.

The investigation was a collaborative effort between the South Dakota Highway Patrol, the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Northern Plains Safe Trails Drug Enforcement Task Force, and the Chamberlain City Police.

Redwater was remanded to the custody of the U.S. Marshal Service pending sentencing, which has been set for June 11, 2013. The maximum penalty upon conviction is 10 years of imprisonment, a $250,000 fine, or both; 3 years of supervised release and an additional 2 years of supervised release upon revocation. Restitution and a $100 special assessment may also be ordered.

Redwater’s plea deal is a stark reminder of the consequences of possessing a firearm as a convicted felon. It is a serious offense that can result in severe penalties.

The case is a testament to the collaborative efforts of law enforcement agencies in South Dakota. It shows that they are committed to keeping the community safe and holding those responsible for breaking the law accountable.
