Fentanyl Kingpin Sentenced to 12 Years
In a shocking turn of events, Joshua Tyler Fulp, a 20-year-old Grand Forks resident, has been sentenced to 12 years in prison for his role in the fentanyl conspiracy operation known as ‘Operation Denial.’
The investigation, which began in January 2014, revealed that Fulp and his co-defendants were receiving shipments of fentanyl from Oregon, with some of the substances obtained from Canada and China. The case took a tragic turn when 18-year-old Bailey Henke of Grand Forks overdosed and died on January 3, 2015, sparking the Organized Crime and Drug Enforcement Task Force to launch a full-scale investigation.
On January 25, 2016, Judge Erickson also handed down sentences to Fulp’s co-defendants, David Todd Noye Jr., 19, and Kain Daniel Schwandt, 20, both of Grand Forks, to 39 months and 42 months in prison, respectively, followed by 36 months of supervised release.
The investigation was a joint effort between the Department of Homeland Security – Homeland Security Investigations, Drug Enforcement Administration, United States Postal Inspection Service, Grand Forks Narcotics Task Force, Royal Canadian Mounted Police, Portland Oregon Police Bureau – Drugs and Vice Division, Portland HIDTA Interdiction Task Force, Oregon State Police, and the Grand Forks Police Department.
U. S. Attorney Christopher C. Myers and Assistant U.S. Attorney Scott Schneider prosecuted the case, which has been hailed as a major victory in the fight against fentanyl trafficking. As part of the sentence, Fulp was ordered to pay $17,264 in restitution jointly and severally with other co-defendants, as well as a $100 special assessment to the Crime Victims Fund.
The sentence sends a strong message that fentanyl trafficking will not be tolerated in North Dakota, and that those who engage in this deadly activity will face severe consequences.
