Sex Crimes in South Dakota: Franklin Love McDaniel Charged
A 33-year-old man from Georgia has been charged with serious sex crimes in South Dakota. Franklin Love McDaniel, a Hahira resident, was indicted in federal district court for enticement of a minor using the internet, sexual exploitation of a minor, and transfer of obscene material to a minor.
The charges against McDaniel relate to his alleged sexual exploitation of underage females between April 2017 and June 2019 in Rapid City via the internet. If convicted, McDaniel could face a mandatory minimum of 15 years up to life in federal prison and/or a $250,000 fine, a mandatory minimum of 5 years up to lifetime supervised release, and a $100 assessment to the Federal Crime Victims Fund.
McDaniel appeared before U.S. Magistrate Judge Daneta Wollmann on March 25, 2020, and pleaded not guilty to the charges. The investigation into McDaniel’s alleged crimes is being conducted by the South Dakota Division of Criminal Investigation, the Department of Homeland Security, the Federal Bureau of Investigation, the Rapid City Police Department, and the Pennington County Sheriff’s office.
Assistant U.S. Attorney Sarah B. Collins is prosecuting the case. McDaniel was released on conditions pending trial, and a trial date has not been set. The charges against McDaniel are merely an accusation, and he is presumed innocent until and unless proven guilty.
