Gallup Man Jailed for Domestic Violence Assault
A 27-year-old Gallup man, Derek Yabeny, has been sentenced to 25 months in prison for assaulting his girlfriend, leaving her with two orbital fractures, which occurred while she was carrying their two-year old toddler on October 7, 2012.
The assault took place at the Shiprock Fair, located on the Navajo Indian Reservation.
Yabeny pleaded guilty to assault resulting in serious bodily injury and was sentenced in federal court on February 19, 2013. As part of the plea agreement, a charge of child abuse was dismissed.
The case was investigated by the Albuquerque office of the FBI and the Shiprock office of the Navajo Nation Division of Public Safety, and prosecuted by Special Assistant U.S. Attorney David M. Adams.
The case was brought pursuant to the Tribal Special Assistant U.S. Attorney (TSAUSA) Pilot Project, which seeks to increase the likelihood that every viable violent offense against Native women is prosecuted in either federal court or tribal court, or both.
Yabeny will also undergo domestic violence counseling and substance abuse counseling as part of his supervised release, which will last for three years following his prison sentence.
He has been in custody since his arrest in October 2012 and will begin serving his 25-month prison sentence.
