Grand Circle Travel Busted for Disability Discrimination

Grand Circle LLC, doing business as Grand Circle Travel, has been caught in a web of disability discrimination, according to a recent settlement agreement reached with the federal government.

At the center of the controversy is a complaint alleging that Grand Circle Travel discriminated against a person with a mobility disability by cancelling a bus tour reservation without offering a reason. The complainant, who used a motorized scooter, alleged that the company cancelled her reservation, made months in advance, despite adding nine additional travelers shortly before the scheduled departure date.

Under the agreement, Grand Circle Travel has agreed to not discriminate against customers with disabilities, including those who use wheelchairs or other mobility aids. The company must also reasonably modify its policies, practices and procedures to avoid discriminating against persons with disabilities.

Furthermore, Grand Circle Travel has agreed to stow mobility aids without assessing a fee and will post a notice on its website and in its office stating that it does not discriminate based on disability. The company will also provide employees with training on its obligations under the Americans with Disabilities Act (ADA).

“By signing this agreement, Grand Circle Travel has affirmed its commitment to providing equal access to customers with disabilities who, like other Americans, have the same right to enjoy tours free from accommodation barriers,” said Thomas E. Perez, Assistant Attorney General for the Civil Rights Division. “We are pleased that Grand Circle Travel has agreed to make its business open to all.”

The settlement requires Grand Circle Travel to pay $20,000 in compensation and as a civil penalty. Title III of the ADA prohibits businesses that serve the public from discriminating against customers with disabilities. The company’s actions have highlighted the importance of making reasonable modifications to policies and procedures to ensure equal access for people with disabilities.
