Greece Man Sentenced for Possessing Child Pornography
A Greece man has been sentenced to 125 months in prison for possessing child pornography, including prepubescent images.
Kevin DiMartino, 38, was convicted of the crime in a U.S. District Court in Rochester, New York. The sentencing was announced by U.S. Attorney James P. Kennedy, Jr.
According to Assistant U.S. Attorney Melissa M. Marangola, who handled the case, the investigation began in 2016 when an undercover law enforcement officer discovered a video file containing child pornography on the internet. Further investigation determined that the video came from an email address belonging to DiMartino.
The officer also discovered that DiMartino made files available for download that contained the rape of children as young as five years of age and a ten-year-old child engaged in sex acts with other children. A search warrant was executed at DiMartino’s residence in January 2017, where a desktop computer, an external hard drive, and a thumb drive were seized. An analysis of the electronic items determined that they contained both child pornography and child erotica.
Approximately 24,000 images of child pornography were found on the seized electronics. DiMartino was released from custody under the supervision of the U.S. Probation Department while the charges were pending, but his bail was revoked in October 2017 after a minor alleged that the defendant sexually abused him at his residence in Greece.
The investigation was conducted by the Federal Bureau of Investigation, under the direction of Special Agent-in-Charge Gary Loeffert and the Greece Police Department, under the direction of Chief Patrick D. Phelan.
The case highlights the importance of vigilance in protecting children from exploitation and abuse. It also underscores the need for law enforcement agencies to work together to bring perpetrators to justice.
