Guatemalan National Charged with Sex Offender Registration Violation
A Guatemalan national, Nelson Yocute, 34, of Newport, has been charged with illegally re-entering the United States and failing to register as a sex offender, announced United States Attorney Zachary Cunha.
According to charging documents, Nelson Yocute, 34, returned to the United States illegally, after being deported following his 2014 conviction in Rhode Island state court on charges of second degree sexual assault. This conviction required him to register as a sex offender, which he failed to comply with.
Yocute allegedly lived and worked in Newport for the last nine years while failing to register as a sex offender. His 2014 state court sentence mandated this registration, but he never fulfilled his obligation.
On May 14th, 2024, Mr. Yocute made an initial appearance in US district court and was ordered detained in federal custody. A federal criminal complaint is merely an accusation, and a defendant is presumed innocent unless and until proven guilty.
The case is being prosecuted by Assistant United States Attorney Denise M. Barton. The matter was investigated by the Newport Police Department, with the assistance of Homeland Security Investigations and the United States Marshals Service.
