A Phoenix gun store owner is accused of helping customers avoid background checks by making false statements on ATF forms.
Esteban Yanez, 34, allegedly aided and abetted individuals who knowingly lied about being the true buyers, allowing felons to purchase firearms three times, federal prosecutors say.
The indictment also alleges Yanez failed to report cash transactions over $10,000 related to gun sales, a requirement for all federal firearms licensees.
A federal grand jury indicted Yanez on eight counts last week, including False Statement During the Purchase of a Firearm and Failure to File Forms 8300 Relating to Cash Received in Trade or Business.
Convictions carry maximum penalties of 5 to 15 years in prison, fines up to $500,000, or both. Yanez is presumed innocent until proven guilty beyond a reasonable doubt in court.
