Dontae Gilbert, a resident of Elizabeth, Pennsylvania, is heading back to prison for nearly a decade after pleading guilty to possessing a firearm as a convicted felon. On May 23, 2024, Gilbert and another man fired a gun at a residence in the 300 block of E. 18th Avenue in Homestead. The motive behind the shooting is unclear, but the consequences for Gilbert are severe.
Gilbert used a stolen Smith & Wesson pistol to shoot at the home and then attempted to flee the scene with his co-defendant in a black Kia. However, law enforcement was hot on their heels and stopped the vehicle, finding Gilbert behind the wheel with the pistol under his seat. Ballistic testing matched the firearm to spent shell casings found at the scene, and gunshot residue was found on Gilbert’s hand.
Gilbert’s prior record didn’t help his case. He was previously convicted in federal court for possessing with the intent to distribute fentanyl and heroin, and for possessing a firearm in furtherance of that drug trafficking crime. At the time of the shooting, Gilbert was only about nine weeks into his supervised release term, which he clearly violated by committing this new crime.
In a combined hearing, Gilbert pleaded guilty to the firearm charge and admitted to violating the terms of his supervised release. As a result, Judge Cathy Bissoon revoked his supervision and sentenced him to 90 months in prison, followed by another three years of supervised release.
