SALT LAKE CITY – Kelly Dean Harvey, 50, of West Jordan, has pleaded guilty in federal court for importing ephedrine into the United States and selling fraudulent erectile dysfunction (ED) drugs. The charges stem from two separate indictments involving conspiracy and misbranding.
In one case, Harvey admitted to conspiring with Mashesh Kumar Bisht and Jorge Eduardo Campos to import shipments of ephedrine from India between 2007 and 2011. He also acknowledged transferring funds to pay for the ephedrine in a manner designed to conceal the illegal nature of the proceeds.
The second case involved conspiracy, wire fraud, mail fraud, and money laundering related to the distribution of ED drugs containing a synthetic ingredient similar to sildenafil citrate. The drugs were marketed as dietary supplements and labeled as 100% natural without disclosing the active ingredient.
Harvey has agreed to forfeit funds from financial accounts, an insurance policy, and IRA accounts, totaling approximately $512,731.75. Sentencing is scheduled for August 14, 2013.
The ephedrine case is being investigated by special agents of the U.S. Immigration and Custom Enforcement’s (ICE) Homeland Security Investigations and IRS Criminal Investigation. The ED drug investigation was led by the FDA’s Office of Criminal Investigations.
Harvey faces a 36-month sentence for both cases, with sentences to run concurrently. Co-defendant Jorge Campos has pleaded guilty, while Mashesh Kumar Bisht remains at large in India.
