PITTSBURGH, Pa. – Francisco Javier Abundes-Montiel, a 32-year-old citizen of Mexico, has been slammed with federal charges for violating immigration laws, according to U.S. Attorney David J. Hickton.
The indictment, which was returned by a federal grand jury on April 9, 2013, specifically targets Abundes-Montiel as the sole defendant in this case.
Abundes-Montiel, who has already been removed from the United States once by U.S. Immigration and Customs Enforcement (ICE), was apprehended again on March 1, 2013, by the Center Township Police Department.
The maximum penalty for such a violation is two years in prison, a fine of $250,000, or both. The actual sentence will depend on the severity of the offense and any prior criminal history of the defendant.
Assistant United States Attorney Margaret E. Picking is spearheading the prosecution of this case on behalf of the government, while ICE conducted the investigation that led to the indictment.
An indictment is merely an accusation, and Abundes-Montiel is presumed innocent until proven guilty.
