JOHNSTOWN, Pa. – Grimy Times Exclusive: Miguel Cortez-Cagal, 32, a citizen of Mexico, has been hit with an indictment for illegal re-entry into the United States after being deported in 2010. The charge stems from Cortez-Cagal’s alleged return to Altoona, Pa., without permission from the Secretary of Homeland Security.
The federal grand jury in Johnstown indicted Cortez-Cagal on April 10, charging him with entering the country after having been deported on Jan. 19, 2010. The offense carries a heavy penalty, with a maximum sentence of two years in prison and a fine of up to $250,000.
Assistant United States Attorney John J. Valkovci, Jr., is leading the prosecution for the government. The Department of Homeland Security/Immigration and Customs Enforcement conducted the investigation that led to the indictment.
Cortez-Cagal’s case highlights the ongoing struggle with illegal immigration and the federal government’s efforts to enforce immigration laws. An indictment is merely an accusation, and the defendant is presumed innocent until proven guilty in a court of law.
The severity of the offense and the defendant’s prior criminal history will determine the actual sentence imposed under the Federal Sentencing Guidelines. This case serves as a stark reminder of the consequences faced by those who defy immigration laws.
