ERIE, Pa. – Rogelio Valencia-Sanchez, a 42-year-old former resident of Oaxaca, Mexico, has been indicted by a federal grand jury in Erie for violating federal immigration laws, according to United States Attorney David J. Hickton.
The indictment, filed against the defendant, alleges that on or about April 22, 2013, Valencia-Sanchez was found to be unlawfully present within the United States. The court documents reveal that he had been previously ordered deported and removed from the U.S. in December 6, 1990, and again on March 29, 2005.
Despite being deported twice, Valencia-Sanchez reentered the country without permission from the Secretary of the Department of Homeland Security and was found to possess a fraudulent Permanent Resident card. This brazen move to circumvent immigration laws has landed him in hot water with federal prosecutors.
The law allows for a maximum sentence of 30 years in prison, a fine of $500,000, or both. Assistant United States Attorney Christine A. Sanner is handling the prosecution on behalf of the government.
This investigation was conducted by the Pennsylvania State Police and the Bureau of Customs and Border Protection. An indictment is merely an accusation, and Valencia-Sanchez is presumed innocent unless proven guilty.
