JOHNSTOWN, Pa. – In a stunning reversal of fate, Jose Arqimedes Guevera-Amaya, 30, has found himself in legal hot water once again after being indicted by a federal grand jury for illegal re-entry into the United States.
The Guatemalan national, who was deported on Oct. 11, 2001, has now been charged with unlawfully returning to the country, according to U.S. Attorney David J. Hickton.
According to the indictment, Guevera-Amaya was apprehended in Blair County, Pennsylvania, on Nov. 19, 2012, having violated federal immigration laws by re-entering without proper authorization from the Attorney General or the Secretary of Homeland Security.
The charges against Guevera-Amaya carry a maximum sentence of two years in prison, a fine of $250,000, or both. Assistant United States Attorney John J. Valkovci, Jr., is now handling the case on behalf of the government.
Investigations into Guevara-Amaya’s illegal return were conducted by the Department of Homeland Security/Immigration and Customs Enforcement (ICE). As with any indictment, it is important to note that Guevera-Amaya is presumed innocent until proven guilty.
