Youngstown’s Ricardo Garcia-Baltazar, also known as Richard Molina, is facing serious federal charges after a grand jury indicted him for impersonating a U.S. citizen and engaging in aggravated identity theft.
The indictment, returned by the Northern District of Ohio’s federal grand jury, alleges that Garcia-Baltazar, 37, falsely claimed to be an American citizen on January 17, 2013. The Mexican national, who was legally an alien in the U.S., also stands accused of transferring, possessing, and using someone else’s identification without authorization between January 17, 2013, and March 8, 2013.
Steven M. Dettelbach, United States Attorney for the Northern District of Ohio, emphasized that if Garcia-Baltazar is convicted, his sentence will be determined by the court on a case-by-case basis, taking into account factors such as his criminal history, role in the offense, and the nature of the violations.
While the investigation leading to this indictment was carried out by the Department of Homeland Security, U.S. Immigration and Customs Enforcement’s Homeland Security Investigations, Assistant United States Attorney Jason M. Katz will be handling the prosecution.
It is important to note that an indictment is merely a charge, and the defendant is entitled to a fair trial where the government must prove guilt beyond a reasonable doubt.
Garcia-Baltazar now awaits his day in court, with the weight of these serious charges resting on his shoulders.
