Letitia James Blocks Trump Funding Freeze, New York NY, 2023

New York Attorney General Letitia James and a coalition of 22 attorneys general celebrated a major legal victory today, securing a court order to block the implementation of a Trump administration policy aimed at freezing federal funding for numerous programs.

The temporary restraining order (TRO) was granted by Judge John J. McConnell of the U.S. District Court for the District of Rhode Island following a lawsuit filed by Attorney General James and the coalition against the illegal funding freeze. The TRO prevents any action that would ‘pause, freeze, block, cancel or terminate’ federal funding provisions unless permitted by statute or grant terms.

Attorney General James emphasized the importance of the victory, stating, ‘The power of the purse belongs to Congress – not the President.’ She vowed to continue fighting in court to protect essential services for New Yorkers.

The TRO, which applies to both current and future federal funding awards or obligations, has protected critical programs such as health care, childcare services, public schools, violence prevention, disaster relief, and more from immediate risk of losing their funding. The Department of Justice (DOJ) has indicated its intent to comply with the court order.

Attorney General James also sent a letter to hundreds of federal funding recipients assuring them that financial assistance cannot be frozen due to the administration’s policy. This includes health care providers, who were informed that they must continue providing services, including gender affirming care, in compliance with New York state laws.

The lawsuit was led by Attorney General James and attorneys general from California, Illinois, Massachusetts, New Jersey, Rhode Island, and 16 other states. The coalition aims to preserve vital federal funding for essential programs across the nation.
