Beckley Man Sentenced to Prison for Possession of a Firearm

BECKLEY, W.Va. – James David Morris, Jr., 43, of Beckley, has been sentenced to two years and 11 months in prison for being a felon in possession of a firearm, and violating his supervised release. The 43-year-old was previously convicted in 2018 for the same crime and was serving a term of supervised release when he committed the 2021 offense.

Morris had been out of prison for less than one year when he was found in possession of a Winchester 12 gauge shotgun by law enforcement officers on June 10, 2021. According to court documents, Morris’ associate fired at least one shot at West Virginia State Troopers during an incident in 2013 that led to Morris’ prior conviction for possession of a firearm by a prohibited person.

United States Attorney Will Thompson commended the Raleigh County Sheriff’s Office and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) for their excellent investigative work.

United States District Judge Frank W. Volk imposed the sentence. Assistant United States Attorney Jeremy B. Wolfe is handling the prosecution.

Morris’ prior convictions include a 2013 federal conviction for possession of a firearm by a prohibited person and a 2018 conviction for being a felon in possession of a firearm. He is not legally permitted to possess firearms due to these prior convictions.

The case is being prosecuted by Assistant United States Attorney Jeremy B. Wolfe and was investigated by the Raleigh County Sheriff’s Office and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
