Letitia James, FTC Click-to-Cancel Regulation Enforcement, New York 2023

New York’s Attorney General, Letitia James, reminded New Yorkers today that the new FTC ‘Click-to-Cancel’ regulation will take effect on July 14, 2025. This new rule simplifies the process for consumers to cancel unwanted subscriptions and automatic renewals. Companies must now make subscription cancellations as easy as sign-ups, allowing customers to cancel using the same method they used to register, whether online, in person, or over the phone. The regulation also requires that cancellation mechanisms be easily accessible online and that consumers cannot be forced to speak with an agent if they did not when signing up.

The FTC’s regulation adds new protections for New York consumers already covered by a state law requiring cancellation processes to be cost-effective, swift, and user-friendly. ‘New Yorkers should never face hurdles just to cancel an unwanted subscription,’ said Attorney General James. ‘The ‘Click-to-Cancel’ regulation will protect consumers and ensure fair business practices. I urge anyone having trouble canceling a subscription to report it to my office, and I will continue to ensure companies across our state comply with the law.’

In addition to simplifying cancellations, the rule requires companies to ensure users know what they are agreeing to before subscribing for automatic renewals. They must also make sure that important subscription information is clear, accurate, and easily accessible. Attorney General James suggested that New Yorkers having trouble canceling a subscription should contact her office via an online complaint.

Attorney General James has been fighting to protect New Yorkers from companies exploiting them through costly, difficult-to-cancel recurring subscriptions. In November 2024, she won a lawsuit to prevent SiriusXM from trapping New York customers with unwanted subscriptions. In December 2023, she obtained $740,000 from online mental health provider Cerebral for its difficult cancellation process. In June 2023, she led a bipartisan group of 26 state attorneys general in submitting a comment letter to the FTC in support of changes to their existing regulations. These changes led to the new ‘Click-to-Cancel’ regulation.

The FTC’s new rule aims to provide clarity and ease for consumers looking to cancel subscriptions without facing unnecessary obstacles. It underscores the commitment of New York’s top law enforcement official to protect consumer rights and ensure fair business practices across the state.
