David Beyer, a 66-year-old resident of Janesville, Wisconsin, was handed down a sentence yesterday by Chief U.S. District Judge James D. Peterson for the theft of social security retirement benefits. The defendant, now on probation for three years, was caught after an SSA OIG investigation revealed he continued to collect $1007 monthly checks from his mother-in-law’s account following her death in 2016.
Beyer had been legally entitled to receive these benefits upon his mother-in-law’s retirement, but his dishonesty came to light when he failed to report her passing. This led to the overpayment of a staggering $62,210.10 to Beyer’s account from July 2016 until January 2022.
United States Attorney Timothy M. O’Shea emphasized the gravity of the offense during sentencing, noting the irony that Beyer now relies on social security benefits, the very program he stole from. Judge Peterson ordered a restitution plan, making it clear that paying back the stolen funds was not considered part of his punishment but rather a just compensation to the SSA.
The investigation and prosecution were carried out by Assistant U.S. Attorney Kathryn Ginsberg. Beyer pleaded guilty on April 4, 2024, marking the conclusion of this financial fraud case.
Despite the defendant’s plea, the sentence handed down serves as a stern reminder of the consequences faced by those who misuse social security benefits. The SSA OIG continues to vigilantly protect the integrity of these vital programs.
