Houston Man Sentenced to 5 Years for Illicit Reentry
A Houston man, Javier Andres Rivera, a Mexican national, was sentenced to 60 months in federal prison for illegally reentering the country without authorization. Rivera has prior convictions for aggravated robbery with a firearm, possession of more than 50 pounds of marijuana, terroristic threats, and illegal reentry. He was first removed from the country in 2011 and illegally returned three times.
According to the U.S. Attorney’s Office for the Southern District of Texas, Rivera was charged with felony reentry after removal and was sentenced by a federal judge in January 2023. The case was referred or supported by federal law enforcement partners, including Immigration and Customs Enforcement – Homeland Security Investigations, ICE – Enforcement and Removal Operations, and Border Patrol.
The U.S. Attorney’s Office for the Southern District of Texas is committed to enhancing enforcement at the border and in the interior of the district to prevent aliens engaged in unlawful activity or with serious criminal histories from entering the country. This includes convictions for human trafficking, sexual assault, and violence against children.

Assistant U.S. Attorneys from all seven divisions work directly with law enforcement partners on the federal, state, and local levels to prosecute suspected offenders of federal crimes.
An indictment or criminal complaint is a formal accusation of criminal conduct, not evidence. A defendant is presumed innocent unless convicted through due process of law.
This case is part of Operation Take Back America, a nationwide initiative to address the crisis at the southern border.
