ROSEBUD, SD – Jeffery Yellow Hawk, 34, of Rosebud, South Dakota, is headed to federal prison after a brazen attempt to evade law enforcement escalated into a direct threat against officers. Chief Judge Roberto A. Lange sentenced Yellow Hawk to 18 months behind bars on December 19, 2023, following a guilty plea entered on October 23, 2023, to charges of Assaulting, Resisting, and Impeding a Federal Officer.
The incident unfolded June 16, 2023, when Yellow Hawk spotted a sobriety checkpoint in the Rosebud area and immediately performed an illegal U-turn, attempting to flee. Rosebud Sioux Tribe Law Enforcement Services officers pursued him to his residence. Ignoring repeated commands, Yellow Hawk then carried two firearms *into* his home, escalating the situation from a simple traffic evasion to a potential standoff.
According to court documents, Yellow Hawk didn’t stop there. He brandished a loaded firearm at the pursuing officers before eventually exiting the residence and being taken into custody. A subsequent search of his home revealed a loaded shotgun and a loaded rifle, both of which will now be forfeited to the government. The evidence paints a clear picture: Yellow Hawk wasn’t just avoiding a checkpoint, he was actively preparing for a confrontation.
Federal prosecutors, led by Assistant U.S. Attorney Kirk Albertson, successfully argued for the 18-month sentence, along with two years of supervised release and a $100 payment to the Federal Crime Victims Fund. The case was a joint investigation by the Rosebud Sioux Tribe Law Enforcement Services and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). The ATF’s involvement underscores the seriousness of the firearms component of the case.
U.S. Attorney Alison J. Ramsdell framed the sentencing as part of the Department of Justice’s “Project Safe Neighborhoods” initiative, a program aimed at reducing violent crime and gun violence through collaboration between federal, state, and local law enforcement. While the program’s goals are laudable, the reality on the ground often falls short, leaving communities like Rosebud vulnerable.
Yellow Hawk was immediately remanded to the custody of the U.S. Marshals Service. This case serves as a stark reminder that evading law enforcement and brandishing firearms will be met with serious federal consequences. The Grimy Times will continue to follow this case and report on the effectiveness of Project Safe Neighborhoods in delivering real safety to vulnerable communities.
