BOSTON – A local man’s alleged misuse of a pesticide has landed him in hot water. According to court documents, Jose Sanchez, Sr., 60, of East Boston, Massachusetts, used a pesticide containing Malathion in his home.
Malathion is only approved for exterior use, and the federal Fungicide, Insecticide and Rodenticide Act (FIFRA) prohibits the use of registered pesticides in a manner inconsistent with their approved labeling. The law is in place to ensure the safety of those who may be exposed to the toxins contained in the pesticide.
The indictment, which was handed down on Thursday, April 30, 2015, charges Sanchez with a single count of Malathion misuse. If convicted, he faces a sentence of no greater than 30 days in prison and a fine of $1,000.
United States Attorney Carmen M. Ortiz and Tyler Amon, Special Agent in Charge of the U.S. Environmental Protection Agency, Criminal Investigation Division, Boston Office, made the announcement today. The case is being prosecuted by Thomas E. Kanwit of Ortiz’s Major Crimes Unit.
The details contained in the indictment are allegations, and Sanchez is presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
Sanchez’s alleged actions have raised concerns about the importance of following safety guidelines when using pesticides. While the risks associated with Malathion are well-documented, many people may not be aware of the potential dangers of misusing the chemical.
The case serves as a reminder of the importance of adhering to established safety protocols when handling potentially hazardous materials.
