Long Island Business Owner Sentenced for Tax Evasion

Joseph Ciccarella, a 54-year-old business owner from Glen Head, New York, was sentenced to 18 months in prison for his role in a tax evasion scheme that involved diverting over $1.6 million from his construction-related companies.

According to the United States Attorney for the Southern District of New York, Preet Bharara, Ciccarella used his companies, BSI Consulting and KMS Mechanical, to funnel the money for personal use without paying his proper share of taxes on that money.

Ciccarella would issue checks from his companies, claiming they were corporate expenses, when in fact they were sham checks that would be cashed and returned to him for his use. He used the funds for personal expenses, including funding for a separate set of companies he owned.

As a result of his scheme, Ciccarella evaded over $280,000 in personal income taxes owed to the Internal Revenue Service (IRS).

Ciccarella previously pled guilty to the charges on November 3, 2016, and was sentenced by United States District Judge Alvin K. Hellerstein.

In addition to his prison term, Ciccarella was sentenced to three years of supervised release and ordered to pay a $100,000 fine. He had previously paid the $284,000 in restitution that was due the IRS.

The case was handled by the Office’s Complex Frauds and Cybercrime Unit, with Special Assistant United States Attorney Stanley J. Okula Jr. leading the prosecution.

The IRS, Criminal Investigations, were also praised for their investigative work on the case.
