NEW ORLEANS, LA – Joshua Hogan is facing a lengthy prison sentence and crippling financial penalties after a federal indictment revealed he’s been dealing fentanyl in the city. The charges, unsealed October 18th, stem from an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
Hogan was indicted on September 29, 2023, by a grand jury in the Eastern District of Louisiana, but the details remained sealed until recently. He now stands accused of four counts of distributing the deadly opioid, a charge that carries significant weight in a nation grappling with a fentanyl crisis.
Counts one and two of the indictment allege Hogan distributed fentanyl, violating Title 18, United States Code, Sections 841(a)(1) and 841(b)(1)(C). A conviction on these counts could land Hogan up to 20 years behind bars, a fine of up to $1,000,000, and a minimum of three years of supervised release, in addition to a $100 special assessment fee.
The stakes are even higher on counts three and four. These charges center around the distribution of 40 grams or more of a mixture containing fentanyl. If found guilty, Hogan could face a sentence ranging from five to 40 years imprisonment, a fine of up to $5,000,000, at least four years of supervised release, and another $100 assessment fee. The quantity of fentanyl involved significantly increases the potential punishment.
Assistant United States Attorney Sarah Dawkins, of the Violent Crime Unit, is leading the prosecution. U.S. Attorney Duane A. Evans announced the indictment, highlighting the federal government’s commitment to dismantling drug trafficking operations in the Eastern District of Louisiana.
The ATF’s investigation uncovered evidence leading to these charges, indicating a concerted effort to target individuals responsible for flooding New Orleans streets with fentanyl. The case serves as a stark reminder of the dangers posed by this potent drug and the relentless pursuit of justice by federal law enforcement.
