Bismarck – A federal judge has sentenced a Mandan man to four years in prison for bank fraud and interstate transportation of stolen livestock, authorities announced on April 6, 2021.
United States District Judge Daniel M. Traynor handed down the sentence to Kelly Anthony Glatt, 39, following a multi-day trial that ended on October 13, 2020. A federal jury found Glatt guilty of bank fraud and interstate transportation of stolen livestock, but acquitted him of interstate sale of stolen livestock.
According to prosecutors, Glatt took out a loan of $1,500,000 from a North Dakota financial institution in 2014 to purchase cattle and livestock-related supplies. However, evidence presented at trial revealed that Glatt had taken affirmative steps to hide collateral from the financial institution, hidden assets from the financial institution and other victims, and fraudulently filed an agricultural statutory lien in another person’s name.
Furthermore, prosecutors alleged that Glatt transported stolen cattle belonging to the financial institution and other victims from North Dakota to South Dakota.
The sentence imposed by Judge Traynor includes 48 months’ imprisonment on the bank fraud charge and 36 months’ imprisonment on the interstate transportation of stolen livestock charge, to run concurrently. Glatt will also serve a three-year term of supervised release on both counts, concurrent with one another. Additionally, he must pay $1,839,846.30 in restitution and a $200 special assessment.
The case was investigated by the Federal Bureau of Investigation, the North Dakota Stockmen’s Association, and the Morton County Sheriff’s Department, and was prosecuted by Assistant United States Attorneys Jonathan J. O’Konek and Eric Lundberg, and Department of Justice Trial Attorney Joseph McFarlane.
The trial was conducted during the COVID-19 pandemic, with COVID-19 safety protocols in place.
