Kelly McGuire, a 54-year-old resident of Greensburg, Pennsylvania, has been accused of stealing a substantial amount of money from his deceased aunt’s Social Security benefits. McGuire pleaded guilty in federal court to a charge of theft of government money, announced United States Attorney David J. Hickton.
The court was advised that between November 3, 1993, and October 3, 2011, McGuire converted $172,375 in Social Security Title II, Old Age, Survivor’s Disability Insurance benefit payments to his own use. He knew he was not entitled to receive these benefits, as his aunt, Lucille McGuire, passed away on October 2, 1993.
Senior United States District Court Judge Maurice B. Cohill accepted McGuire’s guilty plea. The court scheduled sentencing for August 6, 2014, at 2 p.m. Under the Federal Sentencing Guidelines, the actual sentence imposed would be based on the seriousness of the offense and McGuire’s prior criminal history, if any.
McGuire may face a maximum total sentence of not more than 10 years in prison, a fine of $250,000, or both. The Social Security Administration, Office of Inspector General, conducted the investigation that led to the prosecution of McGuire.
Assistant United States Attorney Mary McKeen Houghton is prosecuting this case on behalf of the government. McGuire was released on bond pending sentence.
The case highlights the importance of protecting government funds and preventing theft. McGuire’s actions not only victimized his aunt but also compromised the integrity of the Social Security system.
